TAIPEI (Taiwan News) — The Ministry of Labor reminded employers that Children’s Day on April 3 and Tomb Sweeping Day on April 4 are national holidays, so they must give employees these days off with pay.
If these holidays fall on an employee’s regular day off, the employer and employee should agree on an alternative day off. If the employee works on a national holiday with the employer's consent, the employer must pay double wages, as per Article 39 of the Labor Standards Act.
Tomb Sweeping Day falls on the same date as Children’s Day this year. Due to national holiday regulations as stated in Article 5 of the regulations for national holidays, the Children's Day observance is moved to April 3, per CTEE.
The Ministry of Labor also pointed out that because businesses may have different schedules, rest days and compensatory holidays might not always fall on weekends. Employers should communicate with employees about holiday dates to avoid confusion and ensure fair pay.
The Ministry of Labor stressed that businesses must follow the legal rules for holidays and pay. If employers break these rules, employees can file a complaint with the local labor office or contact the Ministry of Labor’s 1955 hotline to protect their rights.
