Demjanjuk to ask Supreme Court to stop deportation

Demjanjuk to ask Supreme Court to stop deportation

A lawyer for alleged death camp guard John Demjanjuk says he has sent the U.S. Supreme Court a request to halt the deportation of the 89-year-old to face charges in Germany.
John Broadley says he sent the motion Tuesday afternoon from Florida and expects it to be filed with the top U.S. court Wednesday morning.
The U.S. government seeks to deport Demjanjuk, a Ukrainian immigrant, to Germany, where an arrest warrant accuses him of being a guard at a camp in Nazi-occupied Poland in 1943.
Broadley says he will ask for a reprieve of at least 90 days so he can argue that a federal appeals court erred last week when it denied Demjanjuk a stay.
The Justice Department says Demjanjuk and his lawyers have used court filings as a delay tactic.
