CEC amends rules on election chairmanship

The Central Election Commission yesterday passed the amendment on the organic law of local election commission and authorized the CEC to ask the premier to leave the seat vacant of a disqualified member. The member would not be dismissed but simply with the seat left vacant and not be filled.
CEC member Lai Hao-min said being a member on the local election commission was a position of honor without payment, and the seat was usually undertaken by respected individuals with good reputation in the society.
If these members were sacked or dismissed by the CEC, Lai added, it would be disrespectful to them. Lai said to leave the vacant seat would be a better choice than dismissing a commission member.
CEC Secretary General Teng Tien-yu said if the Kuomintang-ruled counties insisted on implementing the "two-step" voting procedure, then members of the CEC could initiate a proposal to the Executive Yuan Premier to leave the seat vacant of the disqualified member.
Teng said the commission had a vote on the final version of the passed clause after a discussion. Members of CEC said a framework of initiation and termination on the commission membership should be established, but a consensus on how to terminate the disqualified member was not reached.
The original clauses stated that the member of local election commission would have the premier to dismiss the member if the member could not fulfill one's duty due to illness, or the member had neglected one's duty, or was indicted or put into custody by prosecutor, or conducted acts to dishonor the reputation of the commission or acts that could affect the fulfilling of one's normal duty.
The CEC members said since the seat of CEC members was appointed by the Premier, it could also be arranged for having the Premier to leave the seat vacant instead of sacking a disqualified member.
After the discussion, a vote was taken with the result of 6 to 3 in favor of the amended version, and with the clause changed from "to dismiss the member" to " to leave the seat vacant." Teng said the decision would soon be sent to the Cabinet for approval and for enforcement after receiving the Cabinet's approval.
The meeting yesterday also passed the amendment to change the original title of "Organic Law of County and City Election Commission in Taiwan Province" into "Organic Law of County and City Election Commission." The meeting also approved to abolish the "Organic Law of County and City Election Commission in Fujian Province."
