MONTGOMERY, Ala. (AP) — A black judge is refusing to step aside from the murder case against a white Alabama police officer who shot a black man.
Montgomery County Circuit Judge Greg Griffin ruled Thursday and accused the defense of injecting race into the case.
Lawyers for Montgomery police officer Aaron Smith argued the judge should recuse himself because of a Facebook post in which he complained about being stopped by police. In the post, Griffin questioned whether he was stopped because he is black.
Smith's lawyers say people on Facebook are comparing what happened to the judge to Smith's confrontation with Greg Gunn, who was shot to death while walking in his neighborhood last year.
The judge's post came weeks after Gunn's death and before Smith's case was assigned to him.
