Ministry of Justice: death penalty should be carried out in accordance with law

Query from Taiwan News on December 20:
Attention: Ministry of Justice

…regarding press reports that the MOJ does not rule out carrying out the death penalty before next February. What is the rationale behind this decision? Given the previous cases of miscarriage of justice by Taiwan authorities, can your authority guarantee that no such miscarriage will happen in the future if the death penalty is still effective in Taiwan?


Reply by Ministry of Justice on January 4:
1. Death sentences shall be carried out according to the law. (meaning law in ROC still stipulates death penalty is effective)
2. Cases that have resulted in the death penalty have gone through a rigorous criminal investigation and trial procedure.
3. Death sentences are carried out following a thorough process and after all other possible avenues have been exhausted.
4. If death sentences are not carried out in accordance with the law, the number of death sentences will increase, leading to difficulties in terms of prison management.
