Rules and Regulation

You are welcomed to join eTaiwannews News Member! These are Membership Terms describing the rights and privileges held by Members as well as notices and disclaimers describing the extent to which Taiwan News, Co. Ltd. is obligated to the Member with regard to its Archives Content services.

The Content of the eTaiwannews Archives (“Content”) is provided by Taiwan News, Co. Ltd. (“Company”). Members of eTaiwannews Archives (“Members”) are asked to read the following Membership Terms (“Terms”). These Terms serve as the eTaiwannews.com Archives Membership (“Membership”) contract and have been written to respect intellectual property rights and define the rights and privileges of Members. If you choose to agree, please complete Membership registration in order to be able to make use of the Membership services. If you do not agree with these Terms, please do not register as a member.

The Company has the legal right to modify or change these Terms without informing individual Members, but an announcement on the eTaiwannews.com Web site (“Web Site”) will indicate that within a reasonable amount of time after such changes have been made. It is recommended that Members periodically check for correction and modification announcement periodically to remain advised of unexpected changes. Continued access of the Web Site after such a correction and modification announcement has been made is automatic acceptance of such corrections and modifications.

Member rights, privileges and limitations

The Web Site grants Members the right and privilege to access, browse, download, save and print (only one copy) one or more records or articles of Content for non-commercial, individual purposes or research.

This right and privilege does not include public transfer of Content and does not grant any rights or privileges restricted by copyright and intellectual property law. Members are not permitted to transfer, utilize or distribute Content to the general public in part or in whole or to use Content in a manner that is harmful to the Company.

The photo archives functions of his Web site are for the access and reference of Members only. If the Member would like to use the photos for any other purpose, request for rights must be made directly from the Company.

Any systemic or commercial use of Content is not covered in these Terms. Such systemic use refers to downloading of Content and using such downloaded material for a similar or independent database or such similar types of storage and republication.

The above-mentioned commercial use refers to use of the Archives for sale as a product in part or in whole or service in part or in whole or for use as information sold as a commercial Web site, as a product or as a service. If there is need for

such usage of Archives Content, please contact the Company to obtain the necessary permission and negotiate terms for rights and privileges of such usage.

Any use of computer programming to access, download, and gather information from the Archives is considered systemic use as mentioned above and discovery of any such usage will result in the immediate termination of all user privileges.

According to these Terms, legal use of the Archives entails protecting copyrights of Content on the Web Site, including but not limited to Content provided by staff reporters, staff writers, contributing writers, supplements writers and 
photographers. Content includes the Taiwan News name and/or logo, headlines, etc..

Only Members of this Web Site who have legally obtained Membership, including individual memberships, institutional organization, educational organization Memberships and comply with these Terms may use the services provided by the

Archives. No protection is provided for any party that is not a Member or any illegal use of the Archives or use of the Archives that is not granted in these Terms.

Membership accounts, passwords and safety:

Members are required to set a Member Username and Password upon setting up an Account. The Members are responsible for protecting their individual Usernames and Passwords and assuring that they are logged out after making use of the Web site to prevent illegal use of their account.

Members are required to log on with this Username and Password to carry out all activities on the Web site.

Members are kindly asked to not release the Username or Password to any third party to protect their rights and privileges and are please asked not to lend or transfer this information to any other party. If a Member discovers that his or her Username or Password have been used illegally by a third party, the Company shall not be held accountable for any loss or damage caused to the Member as a result.

Notice

Upon discovery of any misuse or damage, the Member should immediately notify the Company because the Company otherwise can not effectively prevent further misuse or damage or provide necessary account protections. The Member shall bear the full

responsibility for said misuse or damage until notifying the Company of said misuse or damage.

Member Information

Members are required to provide accurate, detailed Member information fields, including, Name, Date of Birth, Address, E-mail Account Address, Telephone Number &c. and may not provide data that is inappropriate, incomplete, pseudonymous, or misleading. If Member information changes, Members are required to take the initiative and make such changes to the Membership information on the Web Site. If failure to make such adjustments results in harm to Member rights and privileges, the Member is wholly responsible.

Company Obligations

The Archives provided by the Web Site should be taken “as is.” There are no guarantees that Content will meet Member expectations. No guarantee or assurances are granted aside from those mentioned in these Terms.

The Member understands the difficulties of digitalization and therefore the Company can not guarantee the accuracy or consistency of Archives Content and can not be held responsible for any loss or damage that occur to the Member as a result of such errors or inconsistencies.

The Company can not guarantee that Content that has been uploaded, stored or downloaded will be properly displayed or executed in a normal fashion as a result of the open-ended structure of the Internet and can not guarantee that Content will be transferred or stored completely or accurately or that there will be a stoppage of service or error in the process of transfer or storage. The Member understands and agrees that the Company can not be held responsible for any loss of information or computer system damage failure as a result of transfer of Content from the Web Site. If there is any error or omissions as result of services provided by the Web Site, please notify Company staff.

Temporary Suspension or Interruption of Service

The Company reserves the right to employ reasonable methods and techniques to for service maintenance and repair, but can not be held responsibly for any loss or damage that occurs to the Member due to temporary suspension or interruption of service in part or in whole due to the following circumstances:
 
1.Any removal, update, upgrade, maintenance or repair of software
2.Any violation by the Member of the law or these Terms.
3.Acts of God or any other unavoidable occurrences.
4.Any occurrence that is not a result of the Company.
5.Any occurrence that the Company has no control over that results in service Content that appears abnormal or that has been altered, deleted or removed.

If there should be a temporary suspension or interruption of service that occurs without previous notification and that is not the result of any of the above five reasons, but is within the control of the Company, the Company will compensate the Member by number of days the service has been a suspended or interruption.

The Company is obligated to use an appropriate method to notify the Member of any temporary suspension or interruption of service for software maintenance or repair before such temporary suspension or interruption of service occurs.

Member Identity Verification, Expiration of Membership and Web Site Notifications

Student Members are required to use official and valid student identifications. Those who register with an e-mail address may register online. Those register without an email address are kindly asked to send a photocopy of their student identification 
card and fax or mail by post to the Company for identity verification. Student Members who use a false identification card will be held accountable to the law and be required to pay compensation to the Company for damages.

One month and one week before yearly Memberships expire, the Web Site will send an automatic notification to the Member. Members are asked to please keep their account information up to date to assure unobstructed service. If the Member does not receive a notice to renew Membership, the Company can not be held responsible and will not 
compensate the Member.

Members who do not renew before their Membership expires, their Membership will automatically default to Free Membership and any downloaded or digital storage space will be deleted. Members have no say in the matter.

Members who would like to end Web Site Membership may send an e-mail to service@etaiwannews.com or may call the customer service (02-2351-7666). The Company will promptly cancel service and remove Membership information from its database. All rights and privileges held by the Member will be canceled on the day cancellation.

Refunds Notification

If the Web Site is incapable of providing paid service to as a result of reasons that attributable to the Web Site, the Company will compensate with an amount of time equal to the amount of time of the loss of service to the paying Member.

Members who have not used save functions may request for a full refund within seven days of service activation. Those who do not meet the above-mentioned requirements receive no refund.

Privacy Protection

Information recorded or saved on the Web Site are protected under the Taiwan News Co., Ltd. Privacy Statement.

Members agree that the information registered with or saved by the Company may be used, searched, managed, saved, distributed or utilized by the Company or its affiliates in order to provide other information or services to the Member or for in

compiling Membership statistics or to carry on adjustments or research on the Web Site or for other sales or promotional uses.

Limits to these Membership Terms

When these Terms are made invalid in part or in whole are, no other agreement will be affected.

Compliance with the Law and Jurisdiction

The agreement between the Member and the Company must be in compliance with the laws governing the Internet and the Republic of Taiwan Laws. If a dispute between the two arises, the legal proceedings falls under the jurisdiction of Taipei City court. If any declaration or term of the Company is found to be inadequate, a resolution will be sought on the bases of earnestness, trust, fairness and mutual benefit.
